Consumer Cancellation Information

For distance and off-premises consumer contracts where a statutory cancellation right applies

This information applies only where the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 provide a cancellation right. It does not create a cancellation right where a statutory exception applies.

Goods made to your specifications or clearly personalised may be excluded from the normal statutory change-of-mind cancellation right. Faulty, misdescribed or non-conforming goods remain subject to your statutory consumer rights.

1. Your right to cancel

Where the statutory cancellation right applies, you will normally have 14 days to cancel without giving a reason.

For a service contract, the cancellation period normally ends 14 days after the day the contract is entered into. For a contract for goods, it normally ends 14 days after the day you, or a person you nominate other than the carrier, takes physical possession of the goods. Different statutory starting points may apply where goods from one order are delivered separately, in lots or pieces, or by regular delivery. Before you are bound by the order, Taylormade will provide the applicable cancellation information and identify the cancellation period and starting point that apply to your contract.

2. How to cancel

You must tell Taylormade clearly that you wish to cancel. You may use the model cancellation form below, but you do not have to use it. You can send your clear statement by post or email, or tell us by telephone. To meet the cancellation deadline, it is sufficient to send your cancellation before the applicable cancellation period expires.

3. Bespoke and personalised goods

Some Taylormade products are standard products. Products made to your specifications or clearly personalised may fall within a statutory exception to the normal change-of-mind cancellation right. Taylormade will identify before you place the order any products that it considers fall within this exception where that status affects your cancellation rights.

This exception does not affect your statutory rights if goods are faulty, misdescribed or do not conform to the contract.

4. Installation/services started during a cancellation period

If you expressly ask Taylormade to begin an installation or other service during an applicable cancellation period, Taylormade will obtain the request or consent required by law.

If you then validly cancel after the service has started, you may have to pay the legally permitted proportionate amount for the service supplied up to the time you tell us that you are cancelling. Where the legal conditions for loss of the cancellation right following full performance of a service are satisfied, including the required express consent and acknowledgement, the cancellation right may then be lost.

5. Returning standard goods following valid cancellation

This section applies where you validly cancel a contract for goods and the goods do not fall within the made-to-specification or clearly personalised exception.

Unless Taylormade has offered to collect the goods or the law requires Taylormade to collect them, you must send the goods back or hand them over without undue delay and no later than 14 days after the day you tell us that you are cancelling. Return them to the address in section 2 or to another return address that Taylormade gives you.

You will bear the direct cost of returning the goods only where the law permits and Taylormade informed you before the contract that you must pay that cost. Taylormade is responsible for collection where the law requires this, including in certain off-premises contracts where goods were delivered to your home when the contract was made and cannot normally be returned by post.

You may be responsible for any reduction in the value of the goods caused by handling beyond what is necessary to establish their nature, characteristics and functioning, where the law permits.

6. Refunds

Following a valid cancellation, Taylormade will refund payments received from you as required by consumer law. This normally includes the cost of the least expensive standard delivery method offered by Taylormade, but not any extra cost of a more expensive delivery method that you chose.

Where goods are returned, Taylormade may wait until it receives the goods or you provide evidence that you sent them back, whichever happens first. Taylormade will make the refund without undue delay and within the time required by law, using the same payment method that you used unless you expressly agree otherwise. You will not be charged a fee for the refund.

Any deduction for diminished value of goods, or proportionate payment for a service begun at your express request, will be made only where permitted by law. The initial 50% payment is not automatically non-refundable.
